A 37-year-old man living in Hutchinson and entered a guilty plea to blackmail was granted 24-months community corrections on a 24-month underlying sentence. That was the aggravated sentence in the case, but under Kansas sentencing guidelines, the case calls for presumptive probation.

Harold Allen was found guilty of taking sexually explicit photos of his one time girlfriend while they were still dating and after they broke up, and he reportedly sent her text messages threatening to post those photos on the internet if she didn’t give him 750-dollars. That allegedly occurring on March 3rd.

Apparently arrangements were made for him to pick up the money in Carey Park and when he arrived, police were there and he was taken into custody.

He told the judge that he wanted nothing to do with the victim anymore, but did ask that his cell phone be returned. The judge ordered no contact anyway. Judge Chambers also ordered that the hard-drives in the defendant’s laptop and possibly his cell phone which apparently contained the photos be destroyed. He told the two sides, if there is some way to confirm that the pictures on the cell phone are gone, then the phone can be returned, otherwise the phone should be destroyed.

Allen has a person felony for being convicted in Saline County of indecent liberties with a child 14-16 years old for a case back in 2001. He did serve the sentence and was paroled in Ellis County. He also had a juvenile adjudication for a aggravated burglary also from Saline County, but the state now indicates that charge was dismissed.
