The motion hearing for murder suspect Billy Craig Jr., scheduled for Friday was continued one week, because he was not brought to Reno County from the Butler Counter Jail for the hearing.

But, Deputy District Attorney Tom Stanton says this motion of over whether the defense can continued the trial in his drug case, and not the defense motion asking a judge to force the state to honor what they say was a plea agreement for Craig’s cooperation in the murder investigation. Stanton says that motion will be heard at some point in front of Judge Tim Chambers. But, the motion was filed in the file for the drug case, and even the D-A’s own court docket showed the hearing Friday as a motion to endorse a plea.

But, whenever the hearing is heard and in front of who, the defense alleges that on August 24, Craig and the state reached an agreement where he would enter pleas of guilty or no-contest, but then provide law enforcement with truthful and accurate statements and details of the Heckel murder. They say that in exchange, the state agreed to make sentencing recommendations to place Craig on Community Corrections. They also claim that they agreed to refrain from prosecuting Craig for the murder of Heckel. They say that he performed his obligations under the agreement.

The state won’t comment on any plea offers that were made to Craig, so we’ll have to wait for a hearing on that issue.

Craig is charged in the drug case with possession of methamphetamine with intent to sell within a thousand feet of a school and several other felonies, with the case occurring between June 1 and July 2, 2011.

The state alleges he was selling drugs from his home in area close to Hutchinson High School.

You may recall that Craig was found in contempt of court this past week for refusing to take the stand and testify in the trial for Charles Christopher Logsdon.

The hearing on the motion to delay the jury trial in the drug case was rescheduled for next week.
