LATHE (AP) – A trial court judge has postponed a criminal case against a Planned Parenthood clinic in Kansas, only days after a disclosure that the state health department destroyed copies of abortion reports that later became key evidence.

Prosecutors on Monday were granted a delay in a preliminary hearing to determine whether they have enough evidence to go to trial.

District Judge Stephen Tatum gave prosecutors two more weeks to build a case using alternative evidence. Planned Parenthood officials opposed any delays.

The Planned Parenthood clinic in the Kansas City suburb of Overland Park faces 107 charges, including 23 felony counts alleging that it falsified copies of reports on individual abortions performed in 2003 and filed with the health department. The health department shredded its copies in 2005.
