A competency evaluation was ordered for a 44-year-old Hutchinson man by District Judge Joe McCarville late Wednesday afternoon.

Frank Duffy Jr., is charged with two counts of aggravated indecent liberties with a child for inappropriate touching involving two boys, a 13-year-old and a 14-year-old. The alleged crimes occurring back on September 25, 2011.

Defense Attorney Ben Fisher believes his client may not be competent to stand trial and wanted the mental evaluation. District Attorney Keith Schroeder telling us that there is some indication that he may be developmentally disabled.

With the order of the mental evaluation, the case is on hold until the determination if he is able
to understand the charges and able to contribute to his own defense.
