SOUTH HUTCHINSON, Kan. – A 70-year-old Hutchinson man made a first appearance Friday morning in an apparent domestic case where he faces possible charges of aggravated assault with a deadly weapon and domestic battery.

Clarence Elbert Jr. was arrested on the charges Wednesday after South Hutchinson Police were called to the home over a possible overdose. When they arrived, the met the victim and she told officers that she had been battered and that Elbert had taken a large quantity of pills.

The two apparently got into a confrontation and he allegedly struck her on her head and as she tried to escape, he grabbed her by the hair and hit her in the back of the head several times causing her to fall on the floor. She says she then tried to retrieve her phone and that’s when he allegedly grabbed a butcher knife from the counter and pointed it at her. He then told her if she called police, she would be dead before they arrived. He also stated that if they couldn’t be together, they would die together.

She was apparently able to get away from him after he took the pills and fell backwards on the floor.

In court, he was told the potential charges and bond was left at $8,500 and he’ll be back in court on July 1.

Elbert is on parole for kidnapping and rape for a case in Sedgwick County in 1973. He was also arrested on an arrest and detain order for the local parole office.
