SOUTH HUTCHINSON, Kan. – A 70-year-old Hutchinson man made another appearance in court Friday to hear formal charges in an apparent domestic case.

Clarence Elbert Jr. was arrested on the charges of aggravated assault with a deadly weapon and battery-domestic violence on June 22 after South Hutchinson Police were called to the home over a possible overdose. When they arrived, they met the victim and she told officers that she had been battered and that Elbert had taken a large quantity of pills.

The two apparently got into a confrontation and he allegedly struck her on her head and as she tried to escape, he grabbed her by the hair and hit her in the back of the head several times causing her to fall on the floor. She says she then tried to retrieve her phone and that’s when he allegedly grabbed a butcher knife from the counter and pointed it at her telling her that if she called police, she would be dead before they arrived. He also stated that if they couldn’t be together, they would die together.

She was apparently able to get away from him after he took the pills and fell backwards on the floor.

With the formal charges filed, the case will now move to a future-waiver status docket.

Elbert is on parole for kidnapping and rape for a case in Sedgwick County in 1973. He was also arrested on an arrest and detain order for the local parole office.
