After a Judge dismissed one of three cases against a Hutchinson man, the state has refiled the charges.

36-year-old Joshua Rund was arrested on September 6, for charges of criminal possession of a firearm, possession of methamphetamine, possession of marijuana and possession of drug paraphernalia. Also arrested was his 32-year-old wife, Ellen. The two had allegedly gotten a room at 2605 East 4th, but were arrested in the 1100 block of East 11th. But, the state didn’t show any evidence that they had rented the room or that the couple was even it. So, Judge Joe McCarville dismissed that case without prejudice.

The state refiled the charges and he appeared via-video from the Reno County Jail. Magistrate Judge Randy McEwen read the formal complaint and the case again sent to Division 3, for a waiver-status in front of Judge McCarville.

Rund was bound over for trial in two other cases, one going back to August 13, 2012, when drug unit detectives served a search warrant on his home at 3 North Kent Rd., over him allegedly firing a rifle. It’s illegal for him to have guns because of a previous felony conviction. They found the 22-rifle and three handguns. The rifle was found under the couch and the handguns in a safe. They also allegedly found marijuana leading to another search warrant being served and they found marijuana in two places as well as methamphetamine.

At the preliminary hearing last month Rund’s wife, Ellen took the stand and claimed everything was hers including the guns and drugs. She also claimed she never saw Josh shoot the gun.

But, Judge McCarville found probable cause anyway and he was bound over in this case.

He was also bound over in a the third case involving his failure to register as a drug offender back in November of last year.

The refiled case will come before Judge McCarville on December 11. Rund is jailed on a 58-thousand, 500-dollar bond.
