HUTCHINSON, Kan. — The state has filed a motion to consolidate the child sex cases against a Hutchinson man, but the judge declined to hear the motion until other cases make it through the preliminary hearing process.

Kenneth Broadfoot was scheduled for trial on Aug. 9 on a charge of criminal sodomy involving a 15-year-old girl back in September of 2015 following a sexual encounter during the Kansas State Fair.

But because Wichita Attorney Steve Osburn was recently assigned to his cases, he says he will seek a continuance of that trial.

In the other cases, Broadfoot faces charges of aggravated indecent liberties with a child, criminal sodomy of a child 14 to 16 years of age, and aggravated intimidation of a witness in what the state alleges was a conspiracy. Those alleged crimes occurred between June 1, 2014, and May 31, 2015. The state also added seven more counts either accusing Broadfoot of aggravated intimidation of a witness or solicitation to commit aggravated intimidation of a witness. Some of the alleged crimes occurred in December of last year, while others are alleged to have occurred in June.

He’s also charged with solicitation to commit aggravated intimidation of a witness and solicitation for another person to commit perjury. These crimes are alleged to have occurred between Dec. 23 and Dec. 30, 2015.

Hutchinson Police had reported that Broadfoot was arrested after he allegedly made phone calls to an underage girl. When the girl was questioned by police, she admitted to the sexual encounters, leading to the indecent liberties charge. Police could not say how long the two had been in a relationship, but say it could have been more than a year.

Those cases were continued this week to a waiver-status docket on Aug. 10, however, the state indicates that it would like these cases scheduled for a preliminary hearing. So far, that has not happened.
