A 39-year-old Texas man found guilty of aggravated sexual battery was sentenced Friday by District Judge Tim Chambers to 47-months in prison, or just under four years.

This after the defense attorney for Johnathan Riffe failed to convince the judge that his client deserved to be placed on community corrections. Carl Maughn had argued that him being sent to prison would have a big impact on his family, and admits the Riffe had drank to much and made a very bad judgment that night in question.

Senior Assistant District Attorney Steve Maxwell argued that Riffe terrorized the victim and changed her life. He says he found the suggestion of the defendant that this was a consensual thing to be appalling.

The victim spoke to the judge and called Riffe, a mean, lying, vicious person, but the defendant told the judge he made a bad decision, but asked the judge for corrections so he could take care of his family which includes two sons, one 13 and the other 17. Both were in the courtroom. Riffe asked that the judge not torture them anymore, but never apologized to the victim.

Riffe had been charged with attempted rape, and aggravated kidnapping, but the jury found him not guilty on those charges.

The crime occurring in the early morning hours of October 31st, of last year, when Riffe offered the victim a ride home from the Grand Slam nightclub, and the victim alleged that he tried to sexually assault her in the driveway of Hospice House, but the defendant denied that there was anything forced and that the victim was extremely intoxicated. The defendant also told the jury that she wanted him and was into him. But, he says they didn’t have sex because he believed she was to intoxicated.

But, Judge Chambers told the defendant, it wasn’t a wrong moral judgment, it was a violent crime and ordered the sentence executed.

Judge Chambers also denied a defense request for an appeal bond of 75-thousand dollars and set it at a half million.
