The trial for 28-year-old Deron McCoy Jr., continues in Reno County District Court.

McCoy is charged with 19-counts, including two counts of kidnapping, with the case centering on police being called to a domestic dispute at a local motel back on March 22, 2011 between McCoy and the mother of his child. They were apparently disputing custody of their 7-month old daughter. That led to a stalemate between him and law enforcement.

One of the key witnesses, Kaneisha Spencer has not been able to be located. She is the woman who McCoy refers to as his sister and was in the room with him and his child. Deputy District Attorney Tom Stanton did get permission to admit some of her statements in court, despite the objection of Defense Attorney Alice Osburn.

The state did present testimony of a series of a law enforcement officers who were there the night of the stand off.

On the stand Tuesday afternoon was Police Officer Lance Hirt who testified to being called to a possible hostage situation, and was around near the door of the motel room.

McCoy was held up in a room at the Budget Inn Motel at 4th & Washington. After repeated attempts to contact him, police officials decided to rush into the room, and McCoy allegedly had a gun pointed in the direction of Spencer, plus he’s also accused of using the baby as a shield in front of his head when officers entered, however he denies that ever happened. He was taken into custody without incident.

Hirt says he could hear a male voice yelling from the room, “I know you’re out there, I can hear you out there,” and “get back.”

Hirt says he used a key card to unlock the room, then five Emergency Response Team members stormed the room, and he followed as the 6th one in. He says a woman was crying at saying “don’t shoot, don’t shoot.” He says it appeared there was a man behind her and a small child. He later identified the man as McCoy. He also testified that it appeared at one point that he had a gun under Spencer’s chin.

Earlier in the day, Officer Stephen Schaffer, also a member of the E-R-T told the jury that his job during that altercation was to protect officers as they came close to room 115.

They had cut power to the room, and at one point, no longer heard any movement in the room, or the baby crying, so they decided to enter.

Schaffer says as he heard officers enter the room, then heard them yelling, “gun, gun.” Then Spencer was heard saying, “he had a gun to my head.”

Prior to that, Reno County Sheriff Detective John Cully was the negotiator and Schaffer says Cully repeatedly told McCoy who he was and “that they were there to help.”

The case is expected to continue tomorrow in Judge Tim Chambers court.
