A 40-year-old Turon man convicted of one count of attempted aggravated indecent liberties with a child was ordered to prison by Judge Trish Rose who gave Jon Timothy Herrman the standard sentence of 24-months.

The attorney for Herrman, Kelly Driscoll argued for a border box finding and asked that the court grant him community corrections. Driscoll argued that Herrman simply made a mistake, which brought an interruption by the mother of the victim saying “that’s not true.” Judge Rose told her she would need to wait until she is called on to speak. Driscoll also argued that he has only one other felony, that being a DUI.

Herrman was accused of trying to entice or solicit a child 14-16 years of age for sexual relations, but entered a no contest plea to attempted aggravated indecent liberties with a child. He was accused of using a telephone or other electronic means to text the child hoping they would agree to commit or submit to an unlawful sexual act. The alleged crime occurring on July 6, of last year.

The victim’s mother told the court he lives a block and a half away, and believes he is threat to society, and what happened will have a long lasting effect on her daughter.

Herrman told the judge that he screwed up and stated “I will take whatever is coming to me.” He did apologize to the family and the victim.

The state wanted the maximum sentence, while the defense wanted community corrections. Judge Rose stated that she couldn’t find cause to grant any form of probation and ordered the mid-range sentence be served, that being 24-months.

Herrman will also have to register as a sex offender once released from prison.
